This document is legally binding. Please read it carefully before using Awareness.
Critical Risk Disclosures
- AI hallucination and financial loss risk. Awareness uses large language models that can produce inaccurate, fabricated, or misleading outputs. Any AI-generated output, including investment analysis, code, contracts, or factual claims, may be wrong, incomplete, or dangerously misleading. Never use AI output for live financial decisions or other high-risk actions without independent human verification and appropriate professional review.
- AI emotional analysis limitations. AI-based sentiment and emotional inference may fail in edge cases, sarcasm, multilingual contexts, cultural nuance, or extreme conditions. Do not rely on it for safety, mental health, legal, or financial decisions without qualified human review.
- Human confirmation is required for irreversible actions. Before any critical, irreversible, or high-risk action is executed by an AI agent, such as placing orders, deleting data, publishing content, or sending communications, a human user must explicitly approve it.
1. Acceptance of Terms
By creating an account, clicking an acceptance button, or otherwise accessing or using the Awareness platform, APIs, SDKs, MCP server, or related services (collectively, the "Service"), you agree to these Terms, our Privacy Policy, and all applicable laws.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Service Description
Awareness provides AI memory infrastructure, including vector memory storage, retrieval workflows, MCP integrations, SDKs, APIs, and a web dashboard. The Service is intended to enhance AI systems with persistent memory across sessions and environments.
The Service is provided on an "as is" and "as available" basis.
3. Eligibility & Registration
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. You must provide accurate registration information and keep your credentials secure.
You are responsible for all activity that occurs under your account unless prohibited by applicable law.
4. User Responsibilities
4.1 Final Decision-Maker
You are the final decision-maker for instructions given to AI systems operating through the Service. You bear legal and financial responsibility for actions taken based on AI-generated outputs.
4.2 Quality of Inputs
You must ensure that prompts, data, instructions, and uploaded materials are lawful, accurate, complete, and appropriate for your intended use.
4.3 Data Rights
You must have all necessary rights, permissions, and lawful grounds to upload, process, or use any data through the Service.
4.4 Credential Security
You are responsible for safeguarding API keys, OAuth tokens, and account credentials. We are not liable for losses caused by your failure to secure them.
4.5 Human-in-the-Loop Requirement
For critical or high-risk actions, you must implement human review and approval before execution.
5. AI Capabilities & Known Limitations
5.1 Hallucinations and Inaccuracies
AI outputs may be factually wrong, fabricated, incomplete, or misleading. You acknowledge this known limitation of current generative AI systems.
5.2 No Professional Advice
AI-generated outputs do not constitute legal, medical, financial, investment, tax, compliance, or other professional advice.
5.3 Emotional Analysis Limitations
Sentiment and emotional interpretation features are inherently limited and must not be used as the sole basis for consequential decisions.
5.4 No Guarantee of Continuity
Underlying AI models may change, be replaced, or be discontinued. Output consistency across versions is not guaranteed.
6. Prohibited Uses
You may not use the Service for:
- unlawful activity or regulatory evasion;
- market manipulation, securities fraud, or deceptive trading activity;
- malware, ransomware, cyberweapons, or malicious automation;
- infringement of intellectual property or confidential rights;
- phishing, impersonation, social engineering, or fraud;
- unauthorized scraping or harvesting of third-party services;
- unlawful processing of personal data;
- defamatory, discriminatory, threatening, or harassing content;
- bypassing rate limits, access controls, or usage restrictions;
- reselling or sublicensing the Service without authorization;
- any use that creates undue risk to individual or public safety.
7. Third-Party Services & Providers
The Service may integrate with third-party model providers, infrastructure providers, identity providers, and developer tools. Their services are governed by their own terms and policies.
To the maximum extent permitted by law, our liability relating to third-party services is limited, and we do not guarantee uninterrupted performance of third-party systems.
8. Disclaimers of Warranties
To the maximum extent permitted by law, the Service is provided AS IS and AS AVAILABLE, without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted availability.
9. Input & Output Disclaimers
9.1 Your Inputs
You retain responsibility for the legality, quality, and consequences of data and prompts you submit.
9.2 AI Outputs
Outputs may be similar to outputs generated for other users, may contain inaccuracies, and may not be unique. You remain responsible for reviewing and validating outputs before relying on them.
10. Limitation of Liability & Indemnification
10.1 Limitation of Liability
To the maximum extent permitted by law, Awareness and its affiliates, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunities.
10.2 Liability Cap
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid to us in the 12 months preceding the claim or USD 100.
10.3 Indemnification
You agree to defend, indemnify, and hold harmless Awareness from claims arising out of your use of the Service, your data, your violation of law, or your breach of these Terms.
11. Data, Privacy & Security
Our handling of personal data is described in our Privacy Policy. You remain responsible for ensuring that your use of the Service complies with applicable privacy, employment, sector-specific, and export-control laws.
12. Term & Termination
These Terms apply while you use the Service. We may suspend or terminate access if you violate these Terms, create risk for the platform or other users, or if required by law.
You may stop using the Service at any time. Certain provisions, including liability limitations, indemnification, dispute clauses, and sections that by nature should survive, will continue after termination.
13. Governing Law & Dispute Resolution
These Terms are governed by applicable law as specified in your service agreement or, if no separate agreement applies, by the law of the jurisdiction designated by Awareness at the time of contracting, excluding conflict-of-law principles to the extent permitted by law.
Disputes should first be raised through good-faith negotiation. Where permitted, unresolved disputes may be submitted to arbitration or the courts of competent jurisdiction specified in the applicable agreement or order form.
